1. About these terms

These terms apply to every use of matchdaydata.au and to every quote, order, supply and installation by MatchDayData ("we", "us", "our"). "You" means the person or organisation using the site, requesting a quote or placing an order.

By using this site, requesting a quote or placing an order, you accept these terms. If a signed quote or written contract for your order says something different, that document applies to that order.

We may update these terms at any time. The version on this site when you place your order applies to that order.

2. Your rights under Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Every limit on our liability in these terms applies only to the extent the law allows.

3. Prices, quotes and GST

All prices are in Australian dollars and exclude GST unless stated. GST at 10% is added at checkout and shown on your tax invoice.

Prices, specifications and availability may change without notice until we accept your order. Written quotes are valid for 30 days from their date unless they say otherwise.

If a price or description on this site is wrong because of an obvious error, we may correct it before we accept or deliver your order. You can then accept the corrected price or cancel for a full refund of anything you have paid.

4. Orders and acceptance

Your order is an offer to buy. A contract forms only when we confirm acceptance in writing or deliver the goods, whichever happens first.

We may decline or cancel an order before acceptance for any reason, including stock, pricing errors, an unsuitable site or suspected fraud. If we do, we refund anything you have paid in full.

5. Payment and deposits

You must pay the amounts shown at checkout or on your quote, by the due dates shown. Made-to-order and installed orders may require a deposit before we order components, book freight or schedule installers.

If a payment is overdue we may suspend supply or installation until it is paid, and recover our reasonable costs of collecting it.

6. Ownership and security interest

Goods remain our property until we receive payment in full, including GST. Until then you must store and insure them, keep them identifiable as ours, and not sell, lend or mortgage them.

If you do not pay on time we may, after giving you reasonable notice, enter the place where the goods are kept during business hours to recover them.

You grant us a security interest in the goods and their proceeds to secure payment, which we may register under the Personal Property Securities Act 2009 (Cth). Where the goods are not bought for personal, domestic or household use, you waive your right to receive notices under sections 95, 118, 121(4), 130, 132(3)(d), 132(4) and 135 of that Act, and agree that sections 125, 142 and 143 do not apply, to the extent the law allows.

7. Delivery and risk

Delivery and installation dates are estimates. We will keep you informed of changes, but we are not liable for delays outside our reasonable control.

Risk in the goods passes to you when they are delivered to your site, or to your nominated carrier if you arrange freight.

You must provide safe, clear access for delivery vehicles and lifting equipment. Extra costs caused by access problems, waiting time or a failed delivery attempt may be charged to you.

8. Your site and installation

Unless your quote says we will handle them, you are responsible for: council, planning and building approvals; landlord, owner and league consents; locating underground and overhead services; a power supply to the stated specification; and the structural adequacy of any structure we did not supply.

We rely on the site information you give us. Site conditions that were not disclosed or could not reasonably be seen, such as rock, contaminated soil, asbestos, buried services or unsuitable ground, are variations and will be charged at our reasonable cost, with your approval before extra work starts.

You must keep the work area safe and free of people not involved in the installation.

9. What your screen displays

You are solely responsible for everything shown on or played through the screens, including advertising, sponsor material, video, music, broadcasts and camera feeds. That includes holding every licence, broadcast right and consent it needs, and complying with advertising standards, privacy law and any council or road authority rules on brightness, light spill and moving images.

10. Warranty

Any manufacturer or MatchDayData warranty is stated on your quote or product page, and is in addition to your rights under the Australian Consumer Law.

To the extent the law allows, our warranty does not cover damage caused by misuse, accident, vandalism, lightning, power surges, flood, fire, water entering through works by others, modification or repair by anyone other than us or our authorised technicians, failure to follow operating and maintenance instructions, or normal wear, or minor variations in pixel colour and brightness within the manufacturer's tolerance.

11. Cancellations, returns and refunds

Our screens are built or configured to order. We do not accept change-of-mind returns, or cancellation once we have placed a supplier order or started work, except where the law requires it.

If you cancel before we have placed a supplier order or started work, we refund what you have paid less any costs we have actually incurred.

If goods are faulty, contact us promptly. We will repair, replace or refund as the Australian Consumer Law requires. Refunds go back to the original payment method.

12. Limits on our liability

To the maximum extent permitted by law: we are not liable for any indirect or consequential loss, or for any loss of profit, revenue, sponsorship or advertising income, data, goodwill, or the cost of cancelled or disrupted events, however caused.

Where goods or services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for failing to meet a consumer guarantee is limited, at our option, to repairing or replacing the goods, supplying equivalent goods, paying the cost of doing so, supplying the services again, or paying the cost of having them supplied again.

Otherwise, our total liability for all claims relating to an order is limited to the price you paid for that order.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for our fraud.

13. Your indemnity

You indemnify MatchDayData and its owners, officers, employees, contractors and suppliers against all claims, losses, damages, liabilities, penalties and costs (including reasonable legal costs) arising from: your breach of these terms; the content shown on the screens; your site, its approvals and the information you gave us about it; the negligent or wrongful acts of you, your staff or your contractors; and any use of the goods contrary to our instructions or the law.

This indemnity does not apply to the extent a loss was caused by our own negligence or breach of these terms.

14. Using this website

Content on this site is general information. Product images may be illustrative, and dimensions, specifications and brightness figures are approximate until confirmed on your quote.

The site is provided "as is". We do not promise it will be uninterrupted, error-free or free of harmful code.

You must not copy, scrape or harvest the site or its prices, interfere with its operation or security, overload it, or use it for any unlawful purpose.

15. Intellectual property

All content, trade marks, logos, designs and software on this site belong to us or our licensors. Using the site gives you no licence to use them.

Drawings, layouts, designs and specifications we prepare remain our property. When you pay for your order, you get a licence to use them for the goods you bought.

16. Events outside our control

We are not liable for any delay or failure caused by events beyond our reasonable control, including severe weather, natural disaster, supply chain or shipping disruption, pandemic, industrial action, utility failure or government action.

17. Privacy

We handle your personal information as set out in our Privacy Policy.

18. Disputes and governing law

These terms are governed by the laws of South Australia, and you submit to the courts of South Australia.

Before starting proceedings, a party must give the other written notice of the dispute and both must try in good faith to resolve it for 20 business days. This does not stop either party seeking urgent relief from a court.

19. General

If any part of these terms is invalid or unenforceable, it is read down or severed and the rest continues to apply. A failure or delay in enforcing a right is not a waiver of it.

Subject to your rights under the Australian Consumer Law, these terms and your accepted quote are the entire agreement between us for your order. You may not transfer your rights under them without our written consent. We may send notices to the email address you give us.
